3 reasons why your workers’ compensation could be denied

On Behalf of | May 8, 2022 | Your Options

Every job comes with some sort of risk involved — but some are much riskier than others. Some occupations leave workers prone to serious or permanent injuries. Whatever your job entails, you know you have workers’ compensation to help support your needs.

You might have experienced a life-threatening injury and filed for workers’ compensation, only to find your claim denied. Even though workers’ compensation is usually a no-fault system, there are a few reasons your claim can be denied.

Your injuries were the result of a fight you provoked

Violence is rarely the solution when dealing with issues, especially when dealing with work drama. If you were accused of starting a fight that led to your injuries, then your claim might be denied based on the events that took place.

You were found intoxicated or using drugs at your workplace

Many jobs can be boring and repetitive. This doesn’t mean it’s a time to liven your job up with alcohol or drugs. Your job expects you to be in sound mind when you are doing your job. Your claim for benefits could be denied if you sustained injuries while intoxicated or on drugs. It may be believed that your choices were the result of your injuries.

You did not report your injuries in time

Receiving an injury at work and going home to try and sleep it off may put you at risk of losing out on your workers’ compensation. Waiting to report your injury can make it harder for your employer to carry out an accident investigation. You might even be denied workers’ compensation because your employer believes you were injured outside of work.

You shouldn’t have to live the rest of your life in misery because you missed out on workers’ compensation. You may need an experienced eye to help you look over your options if your workers’ compensation was unfairly denied.
